The dispute concerning the investment by the Polish company Control Process in Lviv has reached the highest level of discussions between Warsaw and Kyiv. Finance Minister Andrzej Domański addressed the issue during a press conference following a meeting of the Polish-Ukrainian Intergovernmental Commission for Economic Cooperation.

— Poland and Ukraine agree that difficult topics must also be discussed — stated the minister. — During my visit to Kyiv, these are precisely the matters we are talking about. An example is the investment in Lviv in the waste processing sector, where problems with project settlements have arisen.
Domański emphasized that the matter was directly raised in discussions with key representatives of the Ukrainian government, including Deputy Prime Minister for European Integration Taras Kachka and ministers responsible for the economy.
— Our role as a government is to always advocate for the interests of Polish companies — he noted.

A Dispute Taken to Arbitration
The case concerns the construction of a waste processing plant in Lviv by Control Process. The project was approximately 95% complete, but the city terminated the contract, accusing the contractor of unreliability and attempting to bring in a new contractor.
The crux of the matter is that subsequent arbitration institutions side with the Polish company. The most recent arbitration ruling by the International Chamber of Commerce (ICC) in Paris, dated May 16, 2026, states that:
- the termination of the contract by Lviv was unlawful,
- the attempt to transfer the dispute to arbitration in Kyiv violates the contract’s provisions,
- the contract formally remains in force.
This is another loss for the Ukrainian side — Control Process had previously won in proceedings before the DAB dispute resolution body, which operates according to FIDIC standards.

Despite this, Lviv authorities continue their own strategy: they have released financial guarantees, are planning a new tender, and announce the introduction of a new contractor to the construction site.
„There is Understanding and a Willingness to Resolve”
According to the finance minister, the talks in Kyiv, however, brought a signal that the Ukrainian side recognizes the problem.
— I am very pleased that there is full understanding of this situation from the Ukrainian administration and, moreover, a willingness to take action to resolve it — said the minister.
He added that the investment issue was formally noted in the protocol of the intergovernmental commission meeting. This means the matter has gained official status in the economic relations between the countries.

More Than One Contract
Domański simultaneously sought to temper the significance of the dispute within the broader context of economic relations.
— We have hundreds of successes and dozens more investments that we can develop. Polish companies are very involved in the process of building a strong Ukrainian economy — he stressed.
And he added:
— We cannot allow one situation to cast a shadow on constructive cooperation.
This is an important signal because the stakes of the conflict go beyond the project in Lviv itself. As Control Process points out, the matter could affect companies’ confidence in participating in the future reconstruction of Ukraine — especially if local authorities ignore international dispute resolution mechanisms.
